Most commercial and multi-residential buildings in NSW must lodge an Annual Fire Safety Statement with their local council every 12 months. Failure to comply can result in council fines, fire safety orders and enforcement action.

What Is an Annual Fire Safety Statement?
An Annual Fire Safety Statement (AFSS) is a legal document required under the Environmental Planning and Assessment Regulation 2021 for most Class 2–9 buildings in NSW. It must be prepared and endorsed by an accredited fire safety practitioner (FSP) and lodged annually with your local council and Fire and Rescue NSW.
The statement must include a list of all essential fire safety measures installed in the building, the standard each measure is required to perform to, and confirmation that each measure has been assessed and found to comply.

Once all measures comply, our accredited Fire Safety Practitioner signs and certifies the AFSS within 48 hours of the final inspection confirmation.

Council Lodgement

How often must an AFSS be lodged?
An AFSS must be lodged annually — within 12 months of the previous lodgement. Your fire safety schedule or local council requirements will specify the due date. Contact us if you’re unsure of your next deadline.
What happens if I don’t lodge an AFSS?
Failure to lodge an AFSS can result in council penalty notices, fire safety orders requiring you to bring systems into compliance, and building orders. In serious cases, councils can order the building to be vacated. Don’t risk it — contact us to get back on track.
Can you help with an overdue AFSS?

Who needs an AFSS?
Owners of Class 2 residential flat buildings and Class 3–9 commercial, industrial, public and mixed-use buildings with nominated essential fire safety measures. Can you complete the AFSS inspection and lodge on the same day?
In many cases yes — if all essential fire safety measures are found to be compliant at the time of inspection. If defects are identified, we will need to complete rectification works before certifying. We will be clear about the expected timeline before we begin.
